Booking terms and conditions

THE WEBSITE WWW.YOURAFRICA.COM IS OWNED AND OPERATED BY YOUR AFRICA A DIVISION OF TOURVEST HOLDINGS (PTY) LTD, A COMPANY REGISTERED UNDER SOUTH AFRICAN LAW (REGISTRATION NUMBER 2008/003719/07). THESE TERMS AND CONDITIONS FORM THE BASIS OF YOUR CONTRACT WITH YOUR AFRICA. PLEASE READ THEM CAREFULLY AS THEY ARE LEGALLY BINDING. 

DEFINITIONS AND INTERPRETATION 
In this agreement the following words will have the meanings referred to below, unless the context clearly indicates otherwise: 

  1. “Travel Architect” means a travel adviser employed by Your Africa; 
  2. “the Agreement/Terms and Conditions” means the Customer Booking Form (defined below) and the applicable Customer Quotation read with these Terms and Conditions; 
  3. “Customer Quotation” means the online itinerary or form sent to you by Your Africa, indicating the estimated prices of the travel products and services that you wish to purchase; 
  4. “the Customer Booking Form” means the form completed by you and submitted to Your Africa confirming your acceptance of the Customer Quotation 
  5. “CPA” means the Consumer Protection Act, 2008; 
  6. “Day” means a calendar day; 
  7. “Departure Date” means the date on which you start your travels, as indicated in the Customer Booking Form; 
  8. “Deposit” means the monies payable by you to Your Africa to secure your booking; 
  9. “Force Majeure” means any extraordinary event or circumstance beyond the control of the parties, including but not limited to, whether actual or threatened, war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, pandemics, epidemics (including governmental regulations or interventions in response to pandemics and epidemics) and fire; 
  10. “Your Africa” means Tourvest Destination Management, a division of Tourvest Holdings (Pty) Ltd duly registered in terms of the laws of the Republic of South Africa, carrying on business at Stonewedge Office Park, 1 Wedgewood Link Road, Bryanston, Johannesburg, South Africa, 2021, trading as Your Africa; 
  11. “Involuntary Change” means a change/s to a booking caused by, scheduled airline failure, bad weather, airport or airline strikes and/or caused by a Force Majeure; 
  12. “in writing” means written communication sent to Your Africa by recorded delivery post or by email.
  13. “Your” means the client described on the Customer Booking Form.
  14. “Voluntary Change” means changes requested by you that do not constitute an Involuntary Change which may result in additional costs including but not limited to cancellation, amendment and administration fees and cost of new services;
  15. “Overbooking Displacement” means cancellation or rescheduling of a service by a service provider due to a supplier booking error;
  16. “Parties” means both you and Your Africa;
  17. “Travel Party” means all members of your travelling party as indicated on your Customer Booking Form;
  18. “Supplier” means a third party who supplies you with travel services, including but not limited to airlines, transfer companies, car rental companies, tour operators, hotels and suppliers of accommodation; 
  19. “Supplier Schedule Failure” means a Supplier’s failure to provide you with travel services as per your booking, including but not limited to an Overbooking Displacement; 
  20. “Scheduled Airline Failure” means an airline’s failure to operate at all or to operate according to the flight schedule for reasons including but not limited to technical failure or weather conditions;
  21. “Service Fee” means the portion of your Total Confirmed Price that covers the services provided by Your Africa including but not limited to booking services, administration, communication, amendment, cancellation and bank charges
  22. “Total Confirmed Price” means the total cost of services rendered to you on behalf of Your Africa or by Your Africa, as indicated in the Customer Booking Form
  23. Expressions in the singular also include the plural, and vice versa; and 
  24. Pronouns of any gender include the other gender.

 

PART 1: YOUR DEALINGS WITH YOUR AFRICA IN RESPECT OF TRAVEL SERVICES AND PRODUCTS OFFERED BY SUPPLIERS 

  1. SECURING YOUR BOOKING
    1. In order to confirm your booking, you need to make the following payments to Your Africa: 
      1. 30% Deposit at time of booking, unless full upfront payment is required for certain services such as flights, gorilla permits, peakseason properties, specialist products, or other non-refundable supplier services. 
      2. Final balance due 60 days prior to travel (for fewer than 10 travelers); 
      3. For groups of 10 or more, final payment is due 90 days before travel. 
      4. 100% Of the Total Confirmed Price for bookings made less than 60 days prior to departure (fewer than 10 travelers), or 90 days (more than 10 travelers)
      5. Greater deposits may be required in instances of specialist product and/or peak season travel.
    2. If the above payments are not received as indicated, Your Africa will be unable to confirm the booking for you and Your Africa may treat the booking as unconfirmed or cancelled, and deposits already paid may be forfeited. 

       

  2. PRICES AND PAYMENT
    1. You will be liable for the Total Confirmed Price, less any payments made by you plus any additional charges due to booking changes that may be charged as explained in clause 4 of this Agreement. 
    2. All clients agree to transact with Your Africa using our secure third-party payment vendor (Peach Payments). 
    3. All payments must be made by credit card, internet transfer (electronic funds transfer) or telegraphic transfer (SWIFT). Payments are normally cleared within five business days. Cash and travelers’ cheques are not accepted. 
    4. If you fail to make the payments on or before the due date, your booking will be cancelled, and you will forfeit the relevant deposit paid in terms of clause 1 above. 

       

  3. PRICE INCREASE 
    1. All Customer Quotation Forms and Customer Booking Forms generated by Your Africa are based upon external supplier costs such as air fares, airport taxes, fuel surcharges, accommodation, car hire, park fees and gate fees which are outside of the control of Your Africa. Because these costs are set by external suppliers and are not controlled by Your Africa, the final price of your trip may change until final payment has been received or in the instance of air travel, until air tickets have been issued. 
    2. You agree that should any such costs increase, such an increase will be for your account and shall be payable to Your Africa or as otherwise instructed by Your Africa. 
    3. You also acknowledge that: 
      1. airlines reserve the right to levy additional or increased airport taxes and fuel charges (without notice) at any stage prior to flight and any such costs increased as a result of an increase effected by the airline will be for your account and shall be payable to Your Africa or as otherwise instructed by the airlines; 
      2. road transportation companies such as transfer and car rental companies reserve the right to levy additional charges due to fuel price increases and/or government road levies (without notice) at any stage prior to and any such costs increase as a result of an increase effected by the road transportation company will be your account and shall be payable to Your Africa or as otherwise instructed by the road transportation company; 
      3. Government/National Bodies, concession owners and other such parties involved in the running of private or public natural parks reserve the right to levy additional or increased park fees (without notice) at any stage prior to arrival and any such costs increased as a result of an increase effected by such parties will be for your account and shall be payable to Your Africa or as otherwise instructed by such parties. 
    4. Our commitment to you: Your Africa will always 
      1. work with suppliers to limit any increases, and 
      2. communicate all cost changes to you as soon as we become aware of them. 
    5. Should any details in our Booking Confirmation Letter differ from these Terms & Conditions, the Booking Confirmation Letter will apply. 

       

  4. CHANGES TO BOOKINGS 
    1. Your Africa will make every effort to adhere to the confirmed itinerary. However, where Involuntary Changes are significant, such as change of accommodation or transportation, Your Africa undertakes: 
      1. To provide a reasonable alternative at no additional cost, subject to the terms and conditions of the relevant Supplier; 
      2. In the event that you reject the reasonable alternative provided or should a reasonable alternative not be available as per 4.a.i above, to refund you the monies arising from the Involuntary Changes, subject to the terms and conditions of the relevant Supplier. 
    2. In the event of refunding you, to assist you in identifying alternative services, subject to all additional costs for the alternative services being for your account. 
    3. Should you wish to make a Voluntary Change to your booking, Your Africa will use its best endeavours to accommodate you. Voluntary changes are dependent on availability, supplier rules, and potential price differences. Your Africa reserves the right to charge the applicable cancellation fees referred to in clause 7, together with any additional costs arising from the Voluntary Change, including those charged by the relevant Supplier/s. 

       

  5. TRAVEL DEALS AND DISCOUNT RATES 
    1. All Travel Deals and Discounted Rates that, from time to time, may be advertised on the Your Africa website or quoted in the Customer Quotation Form have separate terms and conditions prescribed by the Supplier of the relevant goods and/or services. It is your responsibility to obtain such separate terms and conditions as you will be bound by them. 

       

  6. WAIVER, INDEMNITY AND LIABILITY 
    1. All vouchers, receipts and tickets issued by Your Africa to you are subject to the supplier’s terms and conditions. 
    2. Participation in any tour or travel package arranged by Your Africa and provided by any of its Suppliers (including but not limited to transportation to or from any venue) is undertaken at your own risk. 
    3. You indemnify Your Africa and its directors, employees, assignees and/or agents against any claim arising for any damages or loss which might be instituted against it arising from or in connection with the services contemplated in these Terms and Conditions. 
    4. You, your heirs, dependents, agents, executors or their assignees hereby irrevocably waive any claims which you/they may have against Your Africa for any form of compensation for damages which you/they may suffer due to injury and/or loss of any nature whatsoever, which includes accidents caused by your own actions, injuries or death while on the tour, in a transportation vehicle or at any place during the tour or illness or death at any time after the tour. 
    5. Your Africa acts solely in the capacity of an agent for third parties and as such Your Africa holds themselves free of responsibility or liability for any delays, loss or damages from any cause whatsoever including loss/ delay/damages/ dissatisfaction caused by third party products and services. Your Africa shall be exempt from all liability in respect of any claim whatsoever as aforesaid, you acknowledging that, in the case of a defective product, it is unreasonable to expect Your Africa to have discovered the product failure having regard to Your Africa’s role in arranging access to the third-party products and services on behalf of yourself. 
    6. Many suppliers have their own terms and conditions. You may be required to sign these on arrival (such as car rental contracts or lodge activity indemnities). We strongly recommend reading and understanding these documents before signing. 

       

  7. CANCELLATION AND REFUND POLICY
    1. In the event that you cancel your booking, in full or partially, for any reason whatsoever Your Africa will levy cancellation charges as defined in Section C below. In the occasional instance where Your Africa is able to obtain waivers of cancellation fees and/or secure an ex-gratia refund from suppliers Your Africa will pass this on to you less the Service Fee. However, Your Africa makes no guarantees as to securing such waivers or refunds. 
    2. Cancellations of bookings must be done in writing. Where cancellations are sent by e-mail, you must obtain an e mail proof of receipt and retain written acknowledgement of receipt from Your Africa. 
    3. Cancellation of bookings 
      1. 61+ days before departure: Deposit non-refundable 
      2. 0-60 days before departure: 100% Cancellation fee (unless otherwise specified by Third-Party Supplier terms) 
    4. Your Africa will make every effort to confirm the required services after deposit payment. In the unlikely event of us being unable to confirm the itinerary travel services, you will be offered alternative available travel services. Should the alternative available travel services not be acceptable to you, we will provide a full refund. 
    5. Should you delay submitting required traveller information (names, passport details, booking forms etc.) this may impact availability, pricing, flight costs, or the itinerary structure. Any resulting price increases or required changes will be for you account. 
    6. Your Africa will make every effort to ensure delivery of services as defined in the confirmed itinerary, however we reserve the right to cancel services when unavoidable due to circumstances beyond the control of Your Africa. In the unlikely instance that Your Africa should cancel services defined in the confirmed itinerary, Your Africa will provide a full refund on the cancelled service/s only, except in Force Majeure events. 
    7. Your Africa will make every effort to avoid misquotation. However, we reserve the right to cancel a reservation without liability or penalty if an obvious error or omission leads to a material cost implication. 
    8. No refunds will be given by Your Africa for partly or unused vouchers, noshows, unutilized accommodation, missed activities or services (regardless of reason). 

       

  8. COMPLAINT AND DISPUTE RESOLUTION 
    1. Any complaints should be telephonically reported to Your Africa at the time of the incident and should be followed up in writing to Your Africa, marked for the attention of the General Manager, Product and Operations, no later than 30 days after the Incident has occurred. 
    2. Complaints should be forwarded via email to [email protected]
    3. Your Africa will acknowledge your complaint and endeavour to investigate it with the relevant service provider within a 30 days period after which we will provide you with written feedback. 
    4. Although Your Africa will make every effort to assist in the resolution of the complaint, it cannot guarantee the satisfactory resolution of complaints for services and products outside of its control and for which it is not responsible. 

 

PART 2: YOUR DIRECT DEALINGS WITH OTHER SERVICE PROVIDERS 

  1. FLIGHT RULES
    1. All airlines require the full names of passengers as stated in their passports. 
    2. After air tickets have been issued, any changes will be subject to the relevant airline’s terms and conditions applicable to that fare type. 
    3. It is your responsibility to check and correct any errors in respect of your flight reservations which appear on the Customer Confirmation Form and Customer Booking Form. Your Africa accepts no liability for incorrect details provided by you. 
    4. Airfares are only guaranteed once final payment has been received and the air ticket has been issued. 
    5. If any airline levies additional or increased airport taxes and fuel charges at any stage prior to your flight, you agree that such an increase will be for your account and shall be payable to Your Africa or to the airline if instructed to do so. 
    6. You must reconfirm all onward and return flights with the relevant airline at least 72 hours prior to your flight. 
    7. Your Africa cannot guarantee any airline seating or meal requests. However, Your Africa will endeavour to assist you in this regard. 
    8. All of your baggage and personal belongings are at all times your responsibility. Your Africa will not accept any liability for your misplaced baggage or any loss or damage to your baggage or personal effects. 
    9. Should you cancel your air ticket, the cancellation will be subject to the relevant airline’s terms and conditions applicable to that fare type. 
    10. Should a refund be granted by the relevant airline, it may be subject to a delay. Your Africa will only be obliged to refund any amounts once it receives them from the relevant airline. 
    11. Air tickets which are unused for more than 1 year from the date of their issue are considered as expired and must be submitted to the relevant airline for their authority to refund. Your Africa will make every effort to assist you in obtaining this refund but cannot provide you with any guarantees in this regard. 
    12. Your Africa will provide you with an e-ticket reference number together with a full itinerary, once the air ticket has been fully paid for. 
    13. In the event of a Voluntary Change, you will be responsible for the difference in all applicable fares and taxes. 
    14. If flights are cancelled, grounded, or delayed due to weather, operational issues, or other factors, Your Africa will assist with arranging alternative travel, however, any additional travel costs are for your account. 
    15. Private or scheduled charter flights are operated by independent companies. 
      1. Your Africa and the charter company are not responsible for delays or cancellations due to weather, technical issues, or unforeseen circumstances. 
      2. A 100% cancellation fee applies to charter flights cancelled within 30 days of departure (or per the charter company’s specific policy). 
      3. Charter luggage rules must be followed strictly.
      4. Any additional flights or transfers required outside your confirmed itinerary are for your account.
      5. Passenger Weight Requirements (Important for Small Aircraft): Travellers weighing 100kg (220 lbs) or more must notify us in advance. Some airlines and charter companies require an extra seat for aircraft weight-balance and safety. Your weight will be collected on the Booking Form for this purpose. 

         

  2. BAGGAGE RULES 
    1. You must ensure that you meet the baggage regulations of the airlines and charter companies that you will be using. Your Africa recommends that you seek the advice of its Travel Architects. However, you remain responsible for ensuring you meet the baggage regulations of each airline and charter company you travel with.
    2. In particular, light aircraft flights have extraordinary baggage regulations which include but are not limited to weight, structure and shape. Your Africa recommends that you seek the advice of its Travel Architects. 
    3. If you do not adhere to the relevant baggage regulations, the transfer of your baggage may be delayed and/or transferred at extra cost to you. 

       

  3. PASSPORTS AND VISAS 
    1. You must ensure that you meet the necessary travel documentation, permit and/or visa regulations of the countries you intend entering, transiting or visiting. Your Africa recommends that you seek the advice of its Travel Architects. However, you remain responsible for ensuring you meet these regulations. 
    2. Your passport must have sufficient blank visa pages available in accordance with the regulations of various African countries. A minimum of 2 adjacent blank pages per country to be entered, transited or visited is required (Your Africa recommends 3 blank pages, as a safety buffer). 
    3. Your passport must be valid for the prescribed period contained in the applicable regulations of the countries you will be entering, transiting and/or visiting. A minimum of 6 months after your return date (the worldwide minimum standard) is recommended. 
    4. If you are travelling alone with minor children, you will need a police-certified letter of consent from the absent parent/s that the children are allowed to travel with you. Border officials may also request the child/children’s unabridged birth certificates (even with both parents present). 

       

  4. INNOCULATION, IMMUNISATION AND MEDICATION 
    1. You must ensure that you meet the immunisation, inoculation and medication regulations of various African countries. Your Africa recommends you seek the advice of its Travel Architects and review the guidelines displayed on its website relating to immunisation, inoculation and medication regulations. However, you remain ultimately responsible for ensuring you meet the immunisation, inoculation and medication regulations requirements of each African country your visit. 
    2. It is your obligation to ensure that you are medically fit to travel. 

       

  5. TRAVEL INSURANCE 
    1. You agree to purchase comprehensive travel insurance at the time of your booking. You acknowledge that without such travel insurance, you will be responsible for all costs arising from any cancellation, re-routing or rescheduling of your trip or any emergency (medical or other) that may arise during your travels. As agreed in Clause 6, you agree that in the event of you failing to purchase adequate insurance cover, you will not hold Your Africa responsible for any harm or loss that you may suffer. 
    2. You must send proof of insurance together with your Customer Booking Form to Your Africa. Credit-card insurance is often limited and typically insufficient for international travel. Please verify your cover directly with your credit-card provider before relying on it. If an insurer disputes or declines a claim, your recourse is solely with the insurer, not with Your Africa. 
    3. Should you cancel your trip and need to file an insurance claim, Your Africa will: 
      1. Cancel your booking with all suppliers, and 
      2. Provide a claims support letter for your insurer. 
      3. Once we notify suppliers of a cancellation in writing, the booking is considered fully cancelled. If you later wish to travel: 
        1. you will need to make a new booking, and 
        2. all new pricing, availability, deposits, and payment terms will apply. 
    4. To assist our guests, Your Africa has partnered with Redpoint Travel Protection, offering access to a range of travel insurance solutions designed to provide peace of mind while travelling. Should you require further information, advice on available cover options, or a quotation, please contact your dedicated Travel Architect, who will be happy to assist and facilitate the process on your behalf. Responsibility for ensuring adequate travel insurance cover remains yourself. 

 

PART 3: THE LEGAL STUFF 

  1. GENERAL 
    1. No amendment, addition or consensual cancellation of this Agreement will be binding unless it is recorded in writing. 
    2. These Terms and Conditions together with the Customer Booking Form and the Customer Quotation contain all the terms and conditions of the agreement between you and Your Africa. Make sure that everything you have agreed to has been recorded in this Agreement. If there is any conflict between the provisions of these documents, the provisions of the Customer Booking Form will prevail. 
    3. If any provision of this Agreement is found by a court of law to be invalid or void, such provision will be severed from the remaining provisions, without affecting the remainder of the agreement. 
    4. If either you or Your Africa chooses not to enforce a right immediately, that does not mean the right has been waived. All rights remain fully enforceable at any time. 
    5. This Agreement shall be governed by the laws of the Republic of South Africa and shall be enforced by the courts within the Republic of South Africa.
    6. You consent to the jurisdiction of the Magistrate’s Court, notwithstanding the fact that the amount involved may exceed the jurisdiction of the Magistrate’s Court. 
    7. If Your Africa has to bring legal proceedings against you to enforce payments of amounts owed to it, you shall be responsible to pay all costs Your Africa incurs in collecting the payment on the scale as between attorney and client. 
    8. You may not transfer (cede) your rights or assign your responsibilities under this Agreement to another party. 
    9. If Your Africa is prevented from carrying out all or any of its obligations under this Agreement because of an event beyond its control, Your Africa shall be relieved of its obligations under the Agreement during the period that such event and its consequences continue, but only to the extent so prevented and shall not be liable for any delay or failure in the performance of any such obligations or loss or damages which you may suffer due to such delay or failure. 
    10. Updated versions of this Agreement may be sent to you from time to time as and when our policies and procedures change and when external factors such as legislative updates require. Please make sure that you read these amended terms and conditions carefully and raise any queries that you may have. 

       

  2. ADDRESSES FOR NOTICES AND LEGAL PROCESS 
    1. For any formal communication, including legal notices, both parties agree to use the following physical addresses: 
      1. Your Africa: Stonewedge Office Park 1 Wedgewood Link Road Bryanston, Johannesburg South Africa, 2021 
      2. You (the Client): The physical address you provide on your Customer Booking Form. 
    2. These addresses are known as the domicilium citandi et executandi, meaning they are the official locations where legal documents and written notices may be delivered. 
    3. Either party may change their official address at any time. To do so, the new address must be: 
      1. provided in writing, and 
      2. received by the other party at least 7 days before the change takes effect. 
      3. Until then, all notices sent to the previous address will still be considered valid. 

         

  3. CONFIDENTIALITY & COMMUNICATION 
    1. Your Africa undertakes to take all reasonable and necessary steps to protect your personal information. 
    2. Your Africa is committed to protecting your privacy and safeguarding all personal information you share with us. This includes, but is not limited to: 
      1. contact details; 
      2. passport and identification information; 
      3. travel documentation; 
      4. payment details; 
      5. medical or dietary information; 
      6. any correspondence or communication with us; 
      7. All such information is handled with the strictest confidentiality. 
    3. Your Africa will never sell, share, or distribute your personal information to third parties unless: 
      1. you give us explicit written consent, 
      2. disclosure is required by law, or 
      3. it is necessary to deliver your travel services (for example, providing your passport details to airlines, lodges, immigration authorities, or hotels). 
      4. Any third-party supplier receiving your information will only receive what is strictly required for operational purposes. 

         

  4. COMPLIANCE WITH PRIVACY LAWS (POPIA & GDPR) 
    1. Your Africa complies with all applicable privacy and data-protection legislation, including: 
      1. The Protection of Personal Information Act (POPIA), Act 4 of 2013, applicable in South Africa; 
      2. The General Data Protection Regulation (GDPR) 2018, applicable for residents of the European Union 
    2. We handle your personal and special personal information (including sensitive medical or dietary data) in accordance with these laws and only for lawful purposes connected to your travel arrangements. 

       

  5. EXCHANGE RATES AND ADJUSTMENTS 
    1. Quotes are prepared using the prevailing exchange rate on the day they are issued. Because exchange rates fluctuate, Your Africa reserves the right to adjust your quote at any time before payment is received. 
    2. If the cost of your trip increases due to a change in exchange rates: 
      1. the increase will be for your account, and 
      2. you agree to settle the difference before the booking is confirmed. 
    3. It is your responsibility to check for any changes to your quote before making payment. Your Africa cannot be held liable for any booking that is cancelled due to delayed or missing payment. 

       

  6. ACCURACY OF INFORMATION 
    1. All information contained in Your Africa quotations, itineraries, invoices, and schedules is provided in good faith and believed to be accurate at the time of preparation. However: 
      1. Your Africa cannot accept liability for errors or inaccuracies in this information. 
      2. You acknowledge that you may have relied on information from third-party brochures, websites, or online sources when choosing your trip. 
      3. These materials are often produced and updated by the Third-Party Suppliers themselves, and Your Africa has no control over their accuracy, completeness, or timeliness. 
    2. Because suppliers manage their own content, Your Africa cannot be held responsible for inaccuracies, outdated descriptions, or variations between advertising and the final experience. 

       

  7. EDITORIAL CONTROL 
    1. Our website includes content provided by third-party partners as well as links to external websites. Your Africa does not screen or monitor this external content, and therefore cannot accept responsibility for any: 
      1. defamatory, 
      2. illegal, or 
      3. harmful material found on those third-party websites. 
    2. If you come across any inappropriate or illegal content through a link on our website, please let us know so we can review it and, if necessary, remove the link. 
    3. Please note that rates shown on our website are indicative only. Prices can vary depending on the season, availability, supplier updates, and other factors. While we always strive to ensure accuracy, all displayed rates should be treated as a guideline until formally quoted by Your Africa.

       

  8.  DISCLAIMER 
    1. Your Africa works hard to ensure that all information on this website is accurate, up to date, and reliable. However, we cannot guarantee that all content, materials, or information on the site will always be complete, error-free, or current. 
    2. Neither Your Africa nor its employees, agents, or partners make any warranties, express or implied, about: 
      1. how the website operates, 
      2. the accuracy of the content, 
      3. or the products and information available through the site. 
    3. By using this site, you agree that Your Africa and its team will not be liable for any kind of damage resulting from: 
      1. your use of the website, or 
      2. your inability to use the website, including (but not limited to) direct, indirect, incidental, punitive, or consequential losses. 

         

  9. ENTIRE AGREEMENT 
    1. These Terms & Conditions, together with any enquiries, advice, quotations, estimates, bookings, and signed indemnities, form the entire agreement between you and Your Africa. 
    2. This means that: 
      1. No other promises, guarantees, representations, or undertakings, spoken or written, form part of your agreement with us unless they are specifically included in this document. 
      2. You acknowledge that you have not relied on any statements made by Your Africa or anyone acting on our behalf that are not recorded here. 
    3. For clarity, the contra proferentem rule (which interprets ambiguous terms against the party that drafted them) does not apply to the interpretation of these Terms & Conditions. 
    4. Your Africa may update or revise these Terms & Conditions from time to time. 
    5. When we do: 
      1. each updated version will be clearly dated, and 
      2. published on our website for your review. 

         

  10. COPYRIGHT 

All content, materials, and documentation provided by Your Africa, including but not limited to these Conditions, proposals, presentations, estimates, quotations, itineraries, designs, layouts, concepts, branding, and any associated intellectual property, are and shall remain the sole and exclusive property of Your Africa. All such materials are protected by applicable South African and international copyright and intellectual property laws. You agree that you may not copy, reproduce, share, distribute, disclose, or use any of these materials for any purpose other than evaluating or booking travel services through Your Africa. Furthermore, you agree not to circumvent Your Africa by approaching, contracting with, or making any direct arrangements, whether in part or in whole, with any supplier, service provider, venue, partner, or third party introduced or proposed by Your Africa for a period of one (1) year from the date any proposal, presentation, estimate, or quotation was submitted to you. This non-circumvention obligation applies regardless of whether the services are identical or only similar in concept, structure, itinerary, or design to those presented by Your Africa. All intellectual property contained in this Agreement, and all related materials, remains fully vested in Your Africa.
